ORDINANCE OF THE BOARD OF SUPERVISORS OF THE COUNTY OF LASSEN
RESCINDING ORDINANCE No. 567 AND CANCELLING A DEVELOPMENT AGREEMENT BETWEEN
THE COUNTY OF LASSEN AND DYER MOUNTAIN ASSOCIATES, LLC AND ITS SUCCESSORS IN INTEREST
BE IT ORDAINED BY THE LASSEN COUNTY BOARD OF SUPERVISORS THAT:
Section 1.    The Lassen County Board of Supervisors finds as follows:
(A)    The Board of Supervisors previously  approved Certification of an EIR (Resolution No. 07-043, adopted September 25, 2007), a Tentative Subdivision Map Application (Resolution No. 07-044, adopted September 25, 2007), and adopted a Development Agreement (Ordinance No. 567, adopted on October 9, 2007) for the Dyer Mountain Project.
(B)    As approved through adoption of Ordinance No. 567, in a document dated November 27, 2007, and recorded on November 30, 2007, as document 2007-08816 in the official records of Lassen County, Dyer Mountain Associates, LLC and the County of Lassen executed a Mitigation/Development Agreement (hereinafter referred to as "the Development Agreement") for the development known as the Dyer Mountain Resort (hereinafter the "Subject Property").
(C)    The Dyer Mountain Project encountered serious financial difficulties shortly following its approval in September of 2007 including the bankruptcy of the original project proponent Dyer Mountain Associates, LLC on or about January 8, 2008.  
(D)    Subsequently, Dyer Holdings, LLC foreclosed on the Subject Property and became record title owner of the Subject Property in 2008.  On March 30, 2009, Dyer Holdings, LLC conveyed its interests to Dyer Management, LLC, as evidenced by that certain Grant Deed recorded on March 30, 2009, in the Official Records of Lassen County, California as Instrument No. 2009-01496.  In a document entitled Assumption of Development Agreement dated December 15, 2009, Dyer Management LLC assumed the Development Agreement.
(E)    The majority owner of Dyer Management, LLC (CMR Mortgage Fund, "CMR") also had financial difficulties and filed its own bankruptcy Petitions in 2008 and 2009 (United States Bankruptcy Court, Northern District of California, San Francisco Division, Consolidated Case Nos. 08-32220, 09-30788, and 09-30802).
(F)    Dyer Management, LLC also defaulted in its financial obligations to the County of Lassen as set forth in the Development Agreement.
(G)    On August 30, 2013, the Bankruptcy Court approved Dyer Management LLC's proposed sale of the Dyer Mountain property to Sierra Pacific Industries (SPI) (Order filed 8-30-2013 in Consolidated Case Nos. 08-32220, 09-30788, and 09-30802).
(H)    On September 19, 2013 SPI closed escrow and became the legal owner of the Subject Property.  SPI's intended use of the Subject Property is for timber management purposes, not for any prior development plans that may have been contemplated on the property.  SPI intends to integrate the property into SPI's sustained yield timber management plan, including all of its wildlife and habitat protection and management plans and related cumulative impact mitigations.
(I)    Also recorded on close of escrow (9-19-2013) was a RESTATED ASSIGNMENT AND ASSUMPTION AGREEMENT (in the Official Records of Lassen County, California as Instrument No. 2013-04821), under which SPI accepted an assignment of the Development Agreement and assumed all of the rights, burdens and obligations of the Owner/Developer as set forth in the Development Agreement.
(J)    Since SPI intends only timber management, any existing discretionary approvals for the Subject Property, including certification of its EIR, Development Agreement and Tentative Subdivision Map, constitute a burden on SPI's ownership.  Accordingly, SPI has requested that Lassen County rescind the Dyer Mountain Project approvals.
Section 2.    Ordinance No. 567, an ORDINANCE OF THE BOARD OF SUPERVISORS OF THE COUNTY OF LASSEN APPROVING A DEVELOPMENT AGREEMENT BETWEEN THE COUNTY OF LASSEN AND DYER MOUNTAIN ASSOCIATES, LLC is disapproved and rescinded.
Section 3.    The Development Agreement, as referenced herein, dated November 27, 2007, and recorded on November 30, 2007, as document 2007-08816 in the official records of Lassen County is cancelled and the land use entitlements expressed therein are extinguished.
Section 4.    This Ordinance shall take effect thirty (30) days after its passage, and before the expiration of fifteen (15) days after its passage a summary shall be published with the names of the members voting for and against the same, once in a local newspaper of the County of Lassen, State of California.

PROFESSIONAL SERVICES FOR PERMIT TRACKING SOFTWARE
FOR THE LASSEN COUNTY DEPARTMENT OF PLANNING AND BUILDING SERVICES
The County of Lassen is seeking proposals from qualified firms for an automated Permit Tracking System (PTS) and document imaging system to process all permits and licenses and to support the processing of all development related functions in the County of Lassen.
The County of Lassen intends to implement a single Permit Tracking System to replace and migrate data from the permitting and inspections tracking system now in use. The current permitting system combines the information tracking needs related to code enforcement, permitting, and inspections of the Lassen County Planning and Building Services Department. The new Permit Tracking System must combine the needs of Building, Planning, Code Enforcement and Surveyor.
All proposals must be received by 4:00 p.m. on Thursday, February 13, 2014.  Five complete proposals must be submitted in a sealed envelope and clearly marked "Proposal for Permitting Software."  Proposals may be submitted in person or mailed to:

NOTICE IS HEREBY GIVEN that the County of Lassen will conduct a public hearing by the Board of Supervisors on Tuesday, February 11, 2014, at 10:15 a.m. in the Board of Supervisors Chambers, 707 Nevada Street, Susanville, in order to discuss possible applications for funding under the Fiscal Year 2014/2015 (July 1 to June 30) State Community Development Block Grant (CDBG) Program to solicit citizen input on possible activities to be included in these applications.
The Community Development and Economic Development Allocations of the State CDBG program publish a combined "Notice of Funding Availability" (NOFA) each program year.  Eligible cities and counties may submit applications for CDBG funds under the NOFA. The maximum award limit is $2,000,000. The Economic Development "Over-the-Counter" (OTC) Allocation requires a separate application with a maximum limit of $3,000,000 per year. The NOFA also includes the Native American and Colonia's Allocations.  The Native American Allocation is only for areas with high concentrations of low-income Native American residents, who are not part of a federally recognized Native American Indian tribe or Rancheria.  The Colonia's funding is only for designated communities within 150 miles of the Mexican-American border.

Provisional Appointment
Notice and Request for Applicants for a Provisional Appointment to the Johnstonville Elementary school District Board of Trustees. Due to the resignation of Board Member, Linda Meusch, effective March 13, 2013, the Board of Trustees voted at its April 10, 2013 meeting to call for a provisional appointment to fill the vacated seat.
