Trial setting conference continued in murder case

July 19, 2012 — Defense attorneys are planning to motion for a change of venue for the trial of Joanna Lynne McElrath and Robin Glen James, and due to the work needing to be completed for that motion, a trial setting conference has been continued.

McElrath and James appeared in Lassen Superior Court Monday, July 9 with their attorneys, Bud Landreth and Larry Barnes.

According to visiting judge John T. Ball, the fact the defendants are planning a motion for change of venue and have retained an individual to start gathering the necessary information for that motion and that the work will not be completed for 90 days, the consensus was nothing could be furthered by motions or hearings in the matter.

As a result, the trial setting conference was placed on the calendar for 11 a.m. Oct. 22.

Ball’s announcement came after he met with the defendants’ counsel and Lassen County District Attorney Bob Burns.

Burns expressed the sentiment he said he made in chambers, which is that the case move forward to trial at a more expeditious rate.

Ball said he understood that position and the court shares his feelings but recognizes the necessity of providing the defendants with a fair trial.

According to Ball, despite the desire of the DA and the court in moving forward expeditiously, it simply cannot be done under the circumstances.

McElrath and James are being held in custody without bail on charges of premeditated murder and conspiracy in the January 2011 death of McElrath’s estranged husband, Robert McElrath, who was an officer with the Susanville Police Department.

This trial should have been completed. I completely agree with Bob Burns. They will of course drag it out as long as possible.

They both killed a cop. Where in the US will they get a fair trial?? I am no lawyer, but knowing all three parties invovled. the eveidence far out weighs any doubt.

GUILTY IS GUILTY IS GUILTY....no need for th county to go broke -offer them a deal they can't refuse that keeps them in harms way while locked up and be done with them-

I enjoy everyone of your comment's. It is absolutely true that they are guilty. To pro-long the judgement for justice, Only cost the tax-payer's of Lassen County time and financial burden's.It doe's not take a rocket scientist to know thier sentence.......Guilty...

The trial should have started long ago. This delay tactic is being used as an excuse for a "fair" trial. They sure weren't fair to Rob. I say expedite and get these two monsters to maximum penalty. The evidence against those two are overwhelming. Quit delaying the inevitable!

More time is needed to gather evidence??? How much more taxpayer money is going to be wasted on this? They premeditated, they acted, and they took away a great man from his children and the community. They are evil. This should have been adjudicated well over one year ago. Enough.
