THE BOARD OF SUPERVISORS OF THE COUNTY OF LASSEN, STATE OF

CALIFORNIA DOES ORDAIN AS FOLLOWS:

SECTION ONE: This ordinance shall take effect thirty (30) days from the date of its passage, and before the expiration of fifteen (15) days after its passage shall be published with the names of the members voting for and against the same, once in a local newspaper within the County of Lassen, State of California.

SECTION TWO:  Ordinance 519 Relating to Emergency Organization of the Lassen County Code is amended to provide as follows:

       Section 3 - Disaster Council Membership:

C.  The Assistant Director/Emergency Services Chief who shall serve as the vice-chairman in the Director’s absence.

     Section 5 - Director and Assistant Director of Emergency Services:

A.  There is hereby created the Office of the Director of Emergency Services.  The Director shall be appointed by the Board of Supervisors.

B.  There is hereby created the Office of the Assistant Director/Emergency Services Chief, who shall be appointed by the Director and approved by the Board of Supervisors.

     Section 6 - Powers and Duties of the Director and Assistant Director/Emergency Services Chief:

C.  The Assistant Director/Emergency Services Chief shall, under the supervision of the Director and with the assistance of Emergency Services staff, develop emergency plans and manage the emergency programs of this County; and he/she shall have such power and duties as may be assigned by the Director.

SECTION THREE: If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional and invalid, such decision shall not affect the validity of the remaining portion of this ordinance. The Board of Supervisors hereby declares that it would have passed this ordinance and every section, subsection, sentence, clause or phrase thereof, irrespective of the fact any one or more sections, subsections, sentences, clauses or phrases be declared unconstitutional or invalid.
