District attorney does not file charges in shooting case; man released from jail

Darrick Bloem’s attorney, Stephen King, also announced Bloem’s release from jail without charges being filed.

On behalf of Bloem, King said, “(Bloem) is very grateful that no harm came to his family during the incident but regrets this senseless tragedy occurred and that a life was lost.”

King also said Bloem expresses his gratitude to his supporters, many of whom are active and retired correctional officers, including his father, Kevin.

Tuesday, May 8 — Based on the facts and evidence, Lassen County District Attorney Bob Burns said he is not convinced, at this time, a crime occurred and he will not be filing charges and has authorized the release of Darrick Gene Bloem, 23, of Susanville, from jail.

Burns made the announcement in a press release issued Tuesday, May 8. He also said the Susanville Police Department (SPD) is continuing to investigate the case.

Bloem was arrested after an investigation into the alleged shooting death of Jason Theodore Hamel, 36, of Susanville that occurred in the early morning of Saturday, May 5.

After Bloem was arrested and in custody, Burns said he was entitled to arraignment within two court days of his arrest.

“For arraignment to occur, charges must be filed beforehand. For charges to be filed, the district attorney must be persuaded by the evidence a crime was committed. If I, as district attorney, am not persuaded that a crime was committed, or there is not enough information to make that determination, charges should not be filed,” Burns said.

He explained that on Monday May 7, the SPD presented the district attorney’s office with an in custody report detailing the circumstances surrounding the shooting death.

According to a press release from the SPD, at approximately 1:35 a.m. Saturday May 5, officers responded to a residence in the 500 block of Wildwood Way in Susanville on a report of shots fired. Upon arrival, officers located an unresponsive man in the entryway of the residence suffering from an apparent gunshot wound to the torso. The victim was identified as Hamel and he was initially transported to Banner Lassen Medical Center via ambulance and was subsequently airlifted to Renown Medical Center in Reno, Nev. Hamel ultimately succumbed to his injuries and died that morning.

According to Burns, facts and evidence support that Bloem and Hamel had a verbal exchange on Friday evening at Diamond Mountain Casino. Ultimately, Hamel was ejected from the Casino by security staff. Bloem and his wife returned to their home.

Some hours later, in the early morning of Saturday May 5, Hamel came to Bloem’s home where he was with his wife, their six-month-old child and Bloem's father.

According to interviews, when Hamel came to Bloem’s home, he announced his presence and Bloem answered the door.

After the door was opened, a struggle ensued in the entryway of the home. Bloem reported Hamel allegedly grabbed him by the throat and began choking him. Marks on Bloem's neck are consistent with the report.

Burns said that during the struggle, Bloem, who had armed himself prior to answering the door, allegedly fired at least one shot that struck Hamel.

Witnesses report Hamel, shortly before he left to go to Bloem’s home, allegedly made a statement, which could only be characterized as a threat towards Bloem.

According to Burns, Hamel allegedly had a criminal history, which included two separate convictions stemming from two separate events on two separate victims out of Nevada for battery with serious bodily injury and appears to have served at least one term in Nevada State Prison. Moreover, Burns said the district attorney’s office is in possession of a SPD report from 2010 wherein Hamel allegedly caused a disturbance, which resulted in a physical altercation in someone else’s home where he was a momentary guest.

Burns said Bloem has no criminal history and has recently returned from serving a tour of duty as a member of the United States military in Afghanistan.

Im in agreement about no charges filed due to home invasion with a previous contact..but the way the paper printed the victims past it came out wrong..as if serving in the war has anything to do with anything ..im a little off put ..he has no past criminal record would have sufficed i think ..

If Bloem felt he needed to arm himself prior to answering the door then the door should've never been opened. He knew they had had an altercation the night before. He should've called 911 BEFORE taking the mans life.

Nah, he is too interested in PETTY marajuana deals to worry or not whether to convict someone who kills someone with a firearm. Burns would make a rotten and corrupt judge and anyone who votes for him is just as corrupt in my honest opinion. I have more to say but out of space to rant more.

A quick 911 call would have sufficed and IF the man had entered the house before police arrived THEN and ONLY THEN would this shooting be justified.

Erica, I don't think a "quick" call was possiable since that man forced his way in and was choking that young man, who in retun fired the fatal shot, to bad the hot headed intruder did not have the common sense to think before hand that it may not turn out in his favor!

Really people? It is not like Bloem casually opened the door and invited him in. He forced his way in, hence him being called an intruder. Bloem wasn't looking for a fight, he grabbed a gun because his 6 month old daughter, wife and father were in the house. He did what was he had to do.

A man had him by the throat, what was he supposed to do, politely ask him to let go so he could call the cops? I feel for the Hamel family but he was not an innocent victim. I am praying for the Hamel family.

Stacy-I believe they mentioned the military aspect because it shows he isn't just a random scum bag. He was and is one of the very few that have served this county. You should actually thank him for fighting to allow you to be able to get on here and voice your liberal opinion.

Okay people seriously???? IT WAS SELF DEFENSE. no prior criminal record on darricks behalf. However Jason had 2 priors! Come on he went over there with intent to harm Darrick. And bloem is not friends with them.

And in the two priors he cause severe bodily harm to people. And he also started a fight in a home that he was guest in. Sounds like he had anger issues. Stop acting like Darrick is such a bad person. Because he is not.

DA Burns is running for election, did Bloem publicly support him or donate? IF so, Burns should have stepped aside and gave this case to the Califonia AG.
Did Bloem have any UCMJ (military) violations?
Bloem should not have been arrested,he has to have his record EXPUNGED at his expense.

Sounds like a smart decision. A real tragic incident, no doubt alcohol was involved. Looks like King is trying to take some credit for this but I dont think it even made it to court. Looking to get his name in the story. Typical defense lawyer. Burns decision took guts to make.

Bob Burns has censored his Facebook campaign page "likes." He needs to open this up, he is a candidate and open government is important, especially in the judiciary.
We must changed the closed government attitude!
Burns, you need to OPEN your Facebook page to ALL so we can SEE!

"King also said Bloem expresses his gratitude to his supporters, many of whom are active and retired correctional officers". Geez Steve, way to use a tragic situation to get a vote. I know all the involved parties of this situation, and although I've never liked Darrick, I think he made a decision

.based on what he thought was protection of his family. None of us were there in his shoes. This is coming from someone who always liked Jason, I really did. Tragic all around. But, Bob is not corrupt. This was a decision he didn't make lightly I'm sure. He makes tough calls everyday and this is

Decided to kill him? Bloem was in his house asleep when dipstick decided to show up at Bloems front door at 1:30 in the morning, and do what he's done in the past! That won't happen anymore! Prayers for the Hamel family, for their loss!

..one of those "damned if you do, damned if you don't". But, Bob made the right call in this situation. Our community needs to stop making this incident politically driven. Bob has more integrity than that. I think after 20 years as a DA, he knows what he is doing. So let's just let him do it.

I think anger was a issue and alcohol provoked Mr. Hamel into not letting a arguement go.Both Mr Bloem and Mr. Hamel were at the casino, When they should have been home with thier families. If Mr. Hamel was as innocent as some of You say, Why did Law Enforcement prove different??
