Invitation For Bids

The Susanville Indian Rancheria (herein called (the Owner") will receive sealed bids for the construction of a five new homes (one two-bedroom, one four-bedroom, and three three-bedroom units) at 4:00 p.m. on the 30th day of June 2014 at the Owner’s administration offices located at 745 Joaquin Street, Susanville, CA 96130. The bid shall include subtotals for each individual unit as well as a total bid price.

Description of work: The selected bidder will construct all units as specified in the manner and timeframe included in the bid package. The bidder must meet all the criteria of the bid package to be eligible. The Work for this project shall be completed in two hundred seventy (270) days or less. Completion delay liquidated damages will be in the amount of seven hundred dollars ($700) per calendar day. The tribe’s Project Manager will be the Susanville Indian Rancheria Housing Authority (SIRHA). Although prevailing wage does not apply to this project, wages must not be lower than SIRHA’s approved wages for the type of work being performed. A copy of the approved wages can be obtained from SIRHA by calling (530) 257-5033.

The Invitation is not restricted and is open to any and all bidders in accordance with 24 CFR 1003.510(d). Although the bid is unrestricted, Indian Preference applies to this project. If a bid is received from at least one responsive and responsible Indian organization or Indianowned economic enterprise and this bid is within five percent of the bid of the lowest responsible bidder, the contract will be awarded to the Indian organization or Indianowned economic enterprise. A bidder claiming Indian preference must complete the Indian Owned Economic Enterprise Qualification Statement included in the bid package, which will be used by Owner to determine whether to provide the bidder with an Indian preference. Bidders claiming Indian preference will be required to submit a completed questionnaire/statement to the Owner in accordance with Section 5 of the Instructions to Bidders.

Bona fide bidders may obtain copies of the proposed contract documents, including plans and specifications, by depositing $30 with NST Engineering, located at 1495 Riverside Drive, Susanville CA 96130, for each set of documents beginning 8:00 a.m. on the 10th day of June 2014. Deposits will be refunded to each person who returns the documents in good condition within ten (10) days after bid opening. No more than two sets of plans will be issued per bidder.

A prebid conference is scheduled for 19th day of June 2014 at 9:00 a.m. at 870 Joaquin Street # G, Susanville, CA 96130. Bidders are urged to inspect the site where Work is to be performed and to satisfy themselves as to all general and local conditions that may affect the cost of performance of the contract to the extent such information is reasonably obtainable. In no event will a failure to inspect the site constitute grounds for withdrawal of a bid after opening or constitute grounds for a claim after contract award.

A bid bond executed by the bidder in an amount equal to five percent (5%) of the bid, is required to be submitted with each bid. An itemized cost breakdown, separating materials and labor, is required with each bid as well as a total itemized cost breakdown for the project.

The contract will be awarded to the lowest responsive and responsible bidder whose bid does not exceed the amount of funds estimated by the Owner to be available for construction of the project, subject to any applicable Indian Preference requirements. Only bids meeting all of the bid requirements included herein shall be considered for award. In the event that the lowest bidder is not awarded a contract, a dissenting contractor has 48 hours in which to file a written complaint.

Bids will be immediately opened and read aloud after the deadline for bid receipt, and taken under advisement for review. Bids may not be withdrawn for a period of thirty (30) days following the opening of bids without the consent of the Owner.

Award of this contract is subject to a determination by the U.S. Department of Housing and Urban Development (HUD) that the contractor is eligible to contract for federally funded activities.

BIDDERS are to base their BIDS on the project funding being provided in whole or in part by Indian Community Development Block Grant funds, which may require review and approval of the contract award, contract agreement, partial and final payments, and CONTRACT CHANGE ORDERS. Payment and retainage will comply with the section of General Conditions entitled “Payment to Contractor.” BIDDERS are notified that this CONTRACT does not permit retainage to be invested for the benefit of the CONTRACTOR.

The Lassen County Department of Public Works is now accepting proposals for Foundation Investigation Studies and reports for four bridge replacement projects in Lassen County. The projects are to replace three timber bridges and one metal bridge. The existing timber structures are Susan River Overflow Bridges 7C-01 and 7C-02 on Mapes Lane and the Long Valley Creek Bridge 7C-12 on Hackstaff Road. The metal structure is the Long Valley Creek Bridge 7C-81 on Hackstaff Road.

This work is subject to State contract nondiscrimination and compliance requirements pursuant to Government Code, Section 12990.

Lassen County has a 12.5% goal for Disadvantaged Business Enterprise (DBE) participation for all Federal funded projects

ADDITION OF BURN PERMIT ORDINANCE

Chapter 6.03 BURN PERMIT REQUIRED

6.03.010 Authority, Intent and Purpose.

This chapter is adopted pursuant to California Government Code Section 61100 (d), which incorporates the provisions of Health & Safety Code Section 13874. Pursuant to said authority, the Board finds and declares that it is necessary to establish a procedure for the requiring of burn permits for all fires and burning of any material outdoors in the District from July 1 through September 30 of each year.

6.03.020 Definitions.

                  As used in this chapter:

                  “Combustion” The act or process of burning in the outdoors

                  “Fires” Combustion of any material causing heat, light and smoke

“Permit” A written order giving permission to have an outdoor fire and duly issued by the Fire Chief (or General Manager of the District) or other officer or employee of the District, which sets forth terms and conditions for any such outdoor burning.

“Red Flag Warning” is a weather event which may result in extreme fire behavior that will occur within 24 hours. A Fire Weather Watch is issued when weather conditions could exist in the next 12-72 hours. A Red Flag Warning is the highest alert.

6.03.030 Open fires prohibited without permit.

It shall be unlawful for any person to cause or create any burning or fire of any nature that is outdoors within the Spalding District from July 1 through September 30 of each year without a permit, except in commercial camping areas. No permit will be issued if there is no permanent water source installed on the property or if a red flag condition has been declared.

6.03.040 Permit issued by the District and Fire Chief.

Any permits issued between July 1 – September 30 will be issued by District Employees or the Fire Chief.

6.03.050 Penalty for violation.

Any person violating any of the provisions of this chapter shall be guilty of an infraction. Ordinance will become effective 30 days after passage
