NOTICE OF PUBLIC HEARING RELATED TO THE POSSIBLE ADOPTION OF REGULATIONS FOR THE CULTIVATION OF MEDICAL MARIJUANA WITHIN THE INCORPORATED LIMITS OF THE CITY OF SUSANVILLE, AMENDMENTS TO TITLE 17 ZONING OF THE SUSANVILLE MUNICIPAL CODE
The City Council of the City of Susanville will hold a public hearing to solicit comments regarding the adoption of Ordinance No. 15-0997 amending various sections of Title 17, Zoning, of the Susanville Municipal Code to add Chapter 17.104.140 "Cultivation of Medical Marijuana." The proposed changes, if adopted by the City Council, would adopt regulations regulating the cultivation of medical marijuana within the incorporated limits of the City of Susanville. The proposed code amendments to title 17 include definitions related to medical marijuana cultivation, limiting the cultivation to residential (R-1, R-2, R-3, and R-4) zoning districts on parcels which must have an occupied residence and in the C-1 and C-2 commercial districts for properties that are developed with a legally established residential use and no commercial land uses. No more than 12 plants may be grown on any parcel. Limitations on the outdoor cultivation require properly fenced rear yards with a prohibition on any outdoor cultivation within 500 feet of a school, child care facility, or public park. Outdoor growing will also be limited to a 120 square feet area which must be setback a minimum of 15 feet from any property line of a parcel which is under a different ownership. Regulations also include requirements for property owner approval where tenants proposed to cultivate medical marijuana. The proposed code also includes a requirement for persons proposing to cultivate medical marijuana to register the growing location and provide valid medical recommendation or county issued medical marijuana cards for each qualified patient for which the marijuana is being grown. Proposed penalties for violations of the ordinance are classified as infractions with fines as provided in the California government code.
The City of Susanville Planning Commission held a public meeting to consider the above-mentioned Zoning Code Amendment as described above on Tuesday, February 10, 2015 at 6:30 p.m. and on Tuesday, March 10, 2015 at 6:30 p.m. and recommended approval of the Draft Ordinance per Resolution No. 15-1017.
That Planning Commission also recommends that the City Council find that the adoption of the ordinance is exempt from the requirements of the California Environmental Quality Act under Section 15061(b)(3) of the California Code of Regulations which states: "The activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA."
In this instance the proposed ordinance relates to activities that are already occurring unregulated within the City. The proposed ordinance will simply require that the activity either occur within an existing residence or occur in the back yard of a lot which has a residential use on it that has already been developed with one or more dwelling units. Furthermore, the actual physical characteristics of cultivation: tilling of soil, watering, harvesting are the same as other accessory residential uses such as gardening, landscaping, etc. Therefore, it can be seen with certainty that no significant environmental impacts will occur as a result of the proposed regulations.
