Tuesday, Aug. 11, 2015 — The Susanville City Council tabled the first reading of a proposed city ordinance prohibiting the cultivation of medical marijuana within the city limits until its first meeting in November.
That’s good news for medical marijuana growers who told the council the new ordinance, if approved as planned, would take effect just before they harvested their gardens this fall — ruining their opportunity to grow their “medicine” and making their now-legal gardens suddenly illegal at the last minute. Of course, it’s bad news for those who oppose the gardens.
Despite the council’s decision to postpone a vote on the ordinance, case law grants the city the legal authority to regulate areas where medical marijuana cultivation will be allowed through its zoning regulations. The council has the ability to completely ban the gardens and dispensaries within the city limits despite the state laws that permit medical marijuana, much to the consternation of the growers.
