DA takes over bad check program
The DA’s office received notification in July that District Attorney Technical Services — the company that managed the bad check program for the past decade — was closing its doors effective immediately.
District Attorney Bob Burns said he had to decide what to do with the program.
“Do I kick it back to the law enforcement agencies and have them do the bad check investigations?” Burns asked the Board of Supervisors on Tuesday, Oct. 10. “Or do I look for some suitable replacement.”
Though there are other firms willing to provide a bad check restitution program, Burns said he decided his office could provide a better service.
“I think I can. I’m asking that we take the program in-house,” he said, adding, “I am not asking for one red cent.”
Burns said he would incorporate the program into his current budget and resources and try to make it a better service.
Supervisor Lloyd Keefer said, “I’m impressed that Mr. Burns is willing to take on a new program and not ask for any money.”
“Mark the date and time,” Burns jokes.
The board unanimously authorized Burns to establish the in-house program, as required by state law.
Merchants previously sent non-sufficient funds checks to the company, with main offices in Fair Oaks for a collection effort.
Merchants’ only options were to use collection agencies or small claims court. Now bad checks can be submitted directly to the DA’s office for restitution.
