Supervisors respond to Grand Jury’s request regarding the Janesville Town
As part of one of its recommendations the grand jury recommended the Lassen County Board of Supervisors should clearly define its existing relationship between the Janesville Town Council.
Craig Settltemire said research and background checking had been done in putting the response together.
Supervisor Lloyd Keefer said he had a chance to review the response, too.
The response says: Notwithstanding the stated purpose of the Janesville Town Council, Inc., in its articles of incorporation to “act as an advisory committee to the Lassen County Supervisors to promote the Janesville community Action Plan,” the Lassen County Board of Supervisors has not taken any formal action to designate the Janesville Town Council, Inc., as an advisory board to the Board of Supervisors.
Although $500 of Lassen County Supervisorial District 3 funds were paid to the Janesville Town Council, Inc., within a couple of months after its incorporation in August 2000 to help defray expenses of incorporation, the Lassen County Board of Supervisors has not delegated any authority to the Janesville Town Council Inc., nor has the Lassen County Board of Supervisors appointed any member of the Lassen County Board of Supervisors to serve as a full voting member of the governing board of the Janesville Town Council, Inc.
As a result, the Janesville Town Council, Inc. would not be subject to the open meeting requirements of the Brown Act (Gov. Code sec. 54952).
The Janesville Town Council has the right, as does any individual or group of constituents, to provide opinions and information to its elected representatives either directly to the Board, or indirectly through the supervisor representing that particular district.
