RECOMMENDATION TO
LASSEN COUNTY BOARD OF SUPERVISORS
The Lassen County Planning Commission solicits the aid of public agencies and the general public in consideration of the following item:
Applicant: Charles Cooper and Debbie Valenta.
File: 2011-016 (Initial Study and Variance).
Project: Variance application to allow additional dogs at an existing kennel. The application is being made pursuant to County Code Section 18.108.025, which does not allow more than 25 dogs (wolf hybrids) on any one parcel. The applicant is proposing 75 dogs in total.
Staff is recommending denial of the proposed project. If the Board of Supervisors decide to disapprove the project, no further environmental analysis is required. If the Board of Supervisors decides to entertain the application, they will direct staff to prepare the appropriate environmental document.
The Planning Commission will make a recommendation to the Board of Supervisors as to whether the Board should deny the Variance application or entertain it.
Location: The project site is located at 529-950 Stage Road (Co. Rd. 504), approximately 12 miles north east of Ravendale.
Zoning: The project site is zoned U-C-2 (Upland Conservation District).

BOARD OF SUPERVISORS
The proposed ordinance would add Chapter 17.02, “Basin Management Objectives” to the Lassen County Code. The ordinance would establish a Basin Management Objective (BMO) program to facilitate the understanding and public dissemination of groundwater data in Lassen County. Development of a BMO program is an implementation measure of the Groundwater Management Plan adopted by the Board of Supervisors on March 13, 2007. The proposed ordinance does not regulate any action or inaction; establish or increase any fees; or impose any penalty for action or inaction. In part the ordinance would:
Establish a Groundwater Committee as standing committee of the Lassen County Board of Supervisors.
Establish a Technical Advisory Committee as standing committee of the Lassen County Board of Supervisors.
Establish management areas, key wells, and action levels.
Establish the requirements of Groundwater Monitoring Annual Report.
Establish the requirements for the collection and reporting of groundwater data.

The Forest Service, Lassen National Forest, Eagle Lake Ranger District has made a preliminary assessment that this proposal falls within a category of actions listed in the Forest Service NEPA Handbook (FSH) that are excluded from documentation in an Environmental Assessment (EA) or Environmental Impact Statement (EIS) and there are no extraordinary circumstances that would preclude the use of category FSH 1909.15, 31.2 (9), “Implementation or modification of minor management practices to improve allotment condition or animal distribution when an Allotment Management Plan is not yet in place. The proposal is to build a horse pasture. The pasture consists of 48 acres, encompassed by 4,455 feet of new fence on three sides and 2,655 feet of the existing Pine Creek fence on the north side and is locate in T33N R9E Sections 34 on Forest Service road 33N07. A draft Decision Memo detailing the proposal is available for review at the Eagle Lake Danger District office. This comment period is intended to provide those interested in or affected by this proposal an opportunity to make their concerns known prior to a decision being made by the Responsible Official. OLD LASSEN COUNTY JAIL
DEMOLITION PROJECT
Will be received at the Office of the Director of Administrative Services, Lassen County, Attn: Regina Schaap, 221 South Roop Street, Suite 4, Susanville, California 96130, until 4:00 pm on May 3, 2012, at which time they will be publicly opened and read in the Administrative Services Conference Room at the above address.
General Work Description:
CONTRACTOR shall, at its sole cost and expense, furnish all facilities, equipment, and other materials necessary for the demolition and removal of the old Lassen County Jail located at 220 South Roop Street in Susanville, California. This building was constructed in 1965 and consists of approximately 4,063 square feet of masonry type construction. Work shall also consist of the removal of an abandoned underground fuel storage tank and the disconnecting, sealing/capping in place all site utilities which cannot be removed. This project will require the removal and some preparatory work to designated lead paint and asbestos containing materials prior to demolition.
At the time this contract is awarded, the Contractor shall possess a Class A, B or Class C21 – Building Moving/Demolition license and in addition the Contractor or the Sub-Contractor who is responsible for the removal of hazardous material shall posses a ASB – Asbestos Certification and a HAZ – Hazardous Substance Removal Certification.
This contract is subject to the provisions of Section 22300 of the California Public Contract Code, which provides for the substitution of securities for any monies withheld by a public agency to ensure performance under a contract. The bidder’s attention is directed to said Section 22300 of the Public Contract Code for the specific requirements and provisions for such substitutions of securities if requested by the Contractor.
This contract is subject to state contract nondiscrimination and compliance requirements pursuant to Government Code, Section 12990.

The successful bidder shall furnish a payment bond equal to one hundred percent (100%) of the contract price and a performance bond equal to fifty percent (50%) of the contract price.
The Contractor shall also furnish Certificates of Insurance, with the County of Lassen named as additional insured, in amounts and coverage as specified in the Specifications.
A pre-bid meeting will be held to answer questions and includes a site inspection for prospective Bidders. The meeting will be held at the location of the Old Lassen County Jail located at 220 South Roop Street, Susanville, California at 10:00 am on Thursday, April 26, 2012. Changes discussed during the pre-bid meeting will not be effective unless it is made in writing as an Addendum, at which time it will be sent to all plan holders.

Pursuant to Section 1773 of the Labor Code the general prevailing wage rates in the county in which the work is to be done have been determined by the Director of the California Department of Industrial Relations. These wage rates are predetermined and set forth in the serially numbered Bid Book issued for bidding purposes entitled, “County of Lassen, State of California, Notice to Contractor’s, Special Provisions, Proposal and Contract for “Old Lassen County Jail Demolition Project” and in copies of said book that may be examined at the offices described above where project, special provisions and proposal forms may be seen or are available from the California Department of Industrial Relations’ Internet web site at http://www.dir.ca.gov. Addenda to modify wage rates, if necessary, will be issued to holders of the above referenced books. Future effective general prevailing wage rates, which have been predetermined, and are on file with the California Department of Industrial Relations, are referenced but not printed in the general prevailing wage rates.
The County of Lassen may waive any informalities or minor defects or reject any and all bids. Any bid may be withdrawn prior to the above scheduled time for the opening of bids or authorized postponement thereof. Any bid received after the time and date specified shall not be considered. No bidder may withdraw a bid within sixty (60) days after the actual date of the opening thereof. Should there be reasons why the contract cannot be awarded within the specified period, the time may be extended by mutual agreement between the County and the bidder.
