Defense submits change of venue for McElrath case

Dec. 12, 2012 — A motion for a change of venue was filed in Lassen Superior Court, today, Wednesday, Dec. 12 for two people being charged with the murder of an off-duty Susanville city police officer.

Attorney Bud Landreth, representing Joanna Lynne McElrath, and making a special appearance for Robin Glen James, said the defense was ready to file the motion for a change of venue for a trial.

Lassen County District Attorney Bob Burns said he received his copy of the motion this morning and expects to file a response on or before Jan. 31.

Visiting Judge John T. Ball set the matter for a hearing at 1:30 p.m. Feb. 22.

The defendants are being held in custody without bail on charges of premeditated murder and conspiracy in the January 2011 death of Robert James McElrath who was Joanna McElrath’s estranged husband.

That should have been done a very long time ago. Seems like a waste of tax payer dollars to drive her from Shasta Country for a 2 second court date.

Venue change needs to be granted as Burns used this crime in his Judge campaign ads - showing possible pre-bias.
Bad move by Burns because a venue change makes this trial much more expensive for we the taxpayers.

For those who watched the Casey Anthony trial. Lassen County is not as wealthy as Orange County Florida.This change of venue is going to happen. I agree with Uncle June Bug. Bob Burns made a lot of mistakes during his campaign. Now Lassen tax payers will pay the cost.

That trial could have never happened in Susanville. There are very very few people that didn't know one or the other of the 3. I personally wish they would have sought the death penalty on them. Very sad her children have to live knowing what a white trash person their mother really is.
