NOTICE IS HEREBY GIVEN that the Lassen County Air Pollution Control District Board of Directors will hold a public hearing on Tuesday, October 12, 2010, at 3:00 p.m., or as soon thereafter as may be heard, in the Susanville City Council Chambers, 66 North Lassen Street, Susanville, California, to consider repeal of Lassen County Air Pollution Control District Rules and Regulations 1:1 through 1:6, and subsequent adoption of a proposed recodification and amendments of Lassen County Air Pollution Control District Rules and Regulations 1:1, 1:2, 1:4, 1:6, 2:16, and 5:22.

The purpose of the recodification of District Rules and Regulations is to streamline the District’s numbering system for better clarity. Staff is also proposing amendments to Rule 1:2 Definitions in order to add new definitions; to Rule 1:3 Air Pollution Monitoring Data- Trade Secrets Defined by renumbering the rule to Rule 2:16 Public Records- Trade Secrets; and to Rule 1:5 Order of Abatement by renumbering the rule to Rule 5:22 Order of Abatement.

The definitions to be added under the proposed changes to Rule 1:2 are for: Agricultural Wastes, Air Pollution, Air Quality Standards, Chimney, Dust, Emission Standard, Fugitive Emissions, Odor, Ozone, Photochemical Process, Refuse, Residential Burning, Smoke, Stack, and Timber Operations. The proposed amendment would remove the definitions for Combustible Waste, Condensed Fumes, and Shall and May. Additionally, the title Residential Rubbish would be updated to Residential Waste.

The proposed ordinance amends Section 3.18.021 of the Lassen County Code regarding Planning and Building Services fees for surface mining and related activities.  The ordinance would amend the minimum “Annual Surface Mine Administration and Operations Monitoring Fee” from the current rate of $300.00 and increase said minimum to $1,000.00. 

The revisions will not change the zoning of any parcel of land.  A complete copy of the proposed ordinance is available for review in the office of the Clerk of the Board of Supervisors.

Notice of Public Hearing

Tentative Subdivision Map & Planned Development Permit

Lake Front at Walker Ranch

Lake Almanor

The Zoning Administrator will hold a public hearing for a Planned Development Permit and Vesting Tentative Subdivision Map for the project known as Lake Front at Walker Ranch. The meeting will be held at 3:00 p.m. on September 23, 2010 at the Veterans Memorial Hall, 500 Stone Avenue in Chester.

The proposed Lake Front project is located in the northeastern portion of Plumas County, California eight miles east of the community of Chester on the west side of the Lake Almanor Peninsula. The site includes assessor’s parcel numbers 103-010-004, 005, 006, 007, 008, 009, 016, 017, 018, and 019; and is located in Township 28 North, Range 7 East, portions of sections 11, 12, 13, 14, 23, and 24. The project encompasses 1,397 acres of land, south of State Route 36 (SR 36), north of the Lake Almanor Country Club, west of County Road A-13 (A-13) and Clifford Drive, and east of Lake Almanor, within Plumas County.

This project is a proposed Planned Development Permit and Vesting Tentative Subdivision Map. The Planned Development Permit proposes a mix of land uses including: single-family and multi-family residential uses, a commercial area, hotel/spa, an Open Space Dedication Area, open space buffers, and golf course land uses. The tentative map’s conceptual site plan for the North area is comprised of seven Land Use Areas (LUAs) totaling approximately 1,032 residential units on 270 acres, a 9-acre commercial area, a 14-acre hotel/spa (150 rooms) area, a 7-acre wastewater treatment plant and 37-acre recycled water storage pond facilities, 22 acres of collector road rights-of-way, and approximately 110 acres set aside as open space buffers. The LUAs vary in density from two dwelling units per acre (du/acre) up to 20 du/acre. The total acreage for the North area comprises approximately 472 acres. Separating the North area from the South area is the Bailey Creek stream corridor and the 188-acre Bailey Creek Open Space Dedication Area. The tentative map for the South area is more detailed in design and includes two LUAs and an Estate Lot Area totaling approximately 642 residential units on 369 acres, a 256-acre golf course facility, and approximately 112 acres set aside as an open space buffer.

The Planned Development Permit would also allow the provision of a one-acre building envelope for a future residence within the open space buffer along Lake Almanor. The LUAs vary in density from 0.65 du/acre in the Estate Lot Area, 8 du/acre in LUA 8, to 1.5 du/acre in LUA 9. The total acreage for the South area is approximately 737 acres. The project would also include construction of local streets and infrastructure. The Planned Development Permit requires diversification in the relationships of structures, lot sizes and open spaces in a planned fashion and allows modifications or exceptions, including transfers of density, from the zoning and subdivision requirements.

In sum, the entire proposed project would include the following uses:

1.674 residential dwelling units, varying in density and design;

9-acre, 100,000 square feet of retail and convenience commercial floor area;

14-acre, 150-room resort hotel/spa;

256-acre, 18-hole golf course;

Approximately 410 acres of open space (including the 188-acre Bailey Creek Open Space Dedication and 222 acres of open space buffers;

7-acre wastewater treatment plant facility and 37-acre recycled water storage ponds, to be managed and operated by the Walker Ranch CSD;

Water supply system (including wells), to be managed and operated by the Walker Ranch CSD; and

Roadways and storm drainage infrastructure.

On March 2, 2010, the Plumas County Board of Supervisors certified Environmental Impact Report #84 for the project known as Lake Front at Walker Ranch, as being complete and adequate, and having been prepared in compliance with the California Environmental Quality Act. The circumstances set forth in Section 15162 of the State CEQA Guidelines have not arisen because there is no substantial evidence of substantial changes in the project which will require major revisions of the previous document due to the involvement of significant new environmental effects or a substantial increase in the severity of previously identified significant effects. Therefore, Environmental Impact Report #84 is adequate and sufficient for this project. Plumas County EIR #84 and all documents referenced therein are available for review at the Department of Planning & Building Services, 555 Main Street, Quincy, CA.

EIR #84 identified significant impacts related to Air Quality, Noise, and Biological Resources that cannot be mitigated to less-than-significant levels. Mitigation measures do not exist to reduce these impacts to less than significant levels, although where possible, feasible mitigation measures have been identified and incorporated into the project relevant to these impacts.

Public Resources Code Section 21081.6(a) requires lead agencies to adopt a reporting and mitigation monitoring program that describes the mitigation measures which have been adopted or made a condition of project approval in order to mitigate or avoid significant effects on the environment. This mitigation monitoring program will be adopted at this hearing.

Project Description:  The goal is to excavate hydrocarbon impacted soils and re-compact with clean soils to existing grade at the Lassen Municipal Utility District (LMUD) property located at 1545 Chestnut Street in Susanville, Lassen County, California.  The excavated soil will be replaced by clean soil from a borrow source located at Duck Hole Road in Wendel.

A mandatory pre-bid walk-thru will commence at LMUD’s Service Center located at 1605 Chestnut Street, Susanville, California at 8:00 AM on Friday, September 17, 2010.

NOTICE IS HEREBY GIVEN that the Lassen County Air Pollution Control District Board of Directors will hold a public hearing on Tuesday, October 12, 2010, at 3:00 p.m., or as soon thereafter as may be heard, in the Susanville City Council Chambers, 66 North Lassen Street, Susanville, California, to consider repeal of Lassen County Air Pollution Control District Rules and Regulations 1:1 through 1:6, and subsequent adoption of a proposed recodification and amendments of Lassen County Air Pollution Control District Rules and Regulations 1:1, 1:2, 1:4, 1:6, 2:16, and 5:22.

The purpose of the recodification of District Rules and Regulations is to streamline the District’s numbering system for better clarity. Staff is also proposing amendments to Rule 1:2 Definitions in order to add new definitions; to Rule 1:3 Air Pollution Monitoring Data- Trade Secrets Defined by renumbering the rule to Rule 2:16 Public Records- Trade Secrets; and to Rule 1:5 Order of Abatement by renumbering the rule to Rule 5:22 Order of Abatement.

The definitions to be added under the proposed changes to Rule 1:2 are for: Agricultural Wastes, Air Pollution, Air Quality Standards, Chimney, Dust, Emission Standard, Fugitive Emissions, Odor, Ozone, Photochemical Process, Refuse, Residential Burning, Smoke, Stack, and Timber Operations. The proposed amendment would remove the definitions for Combustible Waste, Condensed Fumes, and Shall and May. Additionally, the title Residential Rubbish would be updated to Residential Waste.

The proposed ordinance amends Section 3.18.021 of the Lassen County Code regarding Planning and Building Services fees for surface mining and related activities.  The ordinance would amend the minimum “Annual Surface Mine Administration and Operations Monitoring Fee” from the current rate of $300.00 and increase said minimum to $1,000.00. 

The revisions will not change the zoning of any parcel of land.  A complete copy of the proposed ordinance is available for review in the office of the Clerk of the Board of Supervisors.

Notice of Public Hearing

Tentative Subdivision Map & Planned Development Permit

Lake Front at Walker Ranch

Lake Almanor

The Zoning Administrator will hold a public hearing for a Planned Development Permit and Vesting Tentative Subdivision Map for the project known as Lake Front at Walker Ranch. The meeting will be held at 3:00 p.m. on September 23, 2010 at the Veterans Memorial Hall, 500 Stone Avenue in Chester.

The proposed Lake Front project is located in the northeastern portion of Plumas County, California eight miles east of the community of Chester on the west side of the Lake Almanor Peninsula. The site includes assessor’s parcel numbers 103-010-004, 005, 006, 007, 008, 009, 016, 017, 018, and 019; and is located in Township 28 North, Range 7 East, portions of sections 11, 12, 13, 14, 23, and 24. The project encompasses 1,397 acres of land, south of State Route 36 (SR 36), north of the Lake Almanor Country Club, west of County Road A-13 (A-13) and Clifford Drive, and east of Lake Almanor, within Plumas County.

This project is a proposed Planned Development Permit and Vesting Tentative Subdivision Map. The Planned Development Permit proposes a mix of land uses including: single-family and multi-family residential uses, a commercial area, hotel/spa, an Open Space Dedication Area, open space buffers, and golf course land uses. The tentative map’s conceptual site plan for the North area is comprised of seven Land Use Areas (LUAs) totaling approximately 1,032 residential units on 270 acres, a 9-acre commercial area, a 14-acre hotel/spa (150 rooms) area, a 7-acre wastewater treatment plant and 37-acre recycled water storage pond facilities, 22 acres of collector road rights-of-way, and approximately 110 acres set aside as open space buffers. The LUAs vary in density from two dwelling units per acre (du/acre) up to 20 du/acre. The total acreage for the North area comprises approximately 472 acres. Separating the North area from the South area is the Bailey Creek stream corridor and the 188-acre Bailey Creek Open Space Dedication Area. The tentative map for the South area is more detailed in design and includes two LUAs and an Estate Lot Area totaling approximately 642 residential units on 369 acres, a 256-acre golf course facility, and approximately 112 acres set aside as an open space buffer.

The Planned Development Permit would also allow the provision of a one-acre building envelope for a future residence within the open space buffer along Lake Almanor. The LUAs vary in density from 0.65 du/acre in the Estate Lot Area, 8 du/acre in LUA 8, to 1.5 du/acre in LUA 9. The total acreage for the South area is approximately 737 acres. The project would also include construction of local streets and infrastructure. The Planned Development Permit requires diversification in the relationships of structures, lot sizes and open spaces in a planned fashion and allows modifications or exceptions, including transfers of density, from the zoning and subdivision requirements.

In sum, the entire proposed project would include the following uses:

1.674 residential dwelling units, varying in density and design;

9-acre, 100,000 square feet of retail and convenience commercial floor area;

14-acre, 150-room resort hotel/spa;

256-acre, 18-hole golf course;

Approximately 410 acres of open space (including the 188-acre Bailey Creek Open Space Dedication and 222 acres of open space buffers;

7-acre wastewater treatment plant facility and 37-acre recycled water storage ponds, to be managed and operated by the Walker Ranch CSD;

Water supply system (including wells), to be managed and operated by the Walker Ranch CSD; and

Roadways and storm drainage infrastructure.

On March 2, 2010, the Plumas County Board of Supervisors certified Environmental Impact Report #84 for the project known as Lake Front at Walker Ranch, as being complete and adequate, and having been prepared in compliance with the California Environmental Quality Act. The circumstances set forth in Section 15162 of the State CEQA Guidelines have not arisen because there is no substantial evidence of substantial changes in the project which will require major revisions of the previous document due to the involvement of significant new environmental effects or a substantial increase in the severity of previously identified significant effects. Therefore, Environmental Impact Report #84 is adequate and sufficient for this project. Plumas County EIR #84 and all documents referenced therein are available for review at the Department of Planning & Building Services, 555 Main Street, Quincy, CA.

EIR #84 identified significant impacts related to Air Quality, Noise, and Biological Resources that cannot be mitigated to less-than-significant levels. Mitigation measures do not exist to reduce these impacts to less than significant levels, although where possible, feasible mitigation measures have been identified and incorporated into the project relevant to these impacts.

Public Resources Code Section 21081.6(a) requires lead agencies to adopt a reporting and mitigation monitoring program that describes the mitigation measures which have been adopted or made a condition of project approval in order to mitigate or avoid significant effects on the environment. This mitigation monitoring program will be adopted at this hearing.
