District may pay to defend acting general manager

Monday, April 6, 2015 — Honey Lake Valley Resource Conservation District critics have called the decision to use district funds to defend Tim Keesey, its then acting general manager, in the lawsuit filed by the Lassen Irrigation Company a gift of public funds. The district’s critics contend Keesey was required to carry error and omissions insurance coverage as part of his contract, and that insurance should pay for his legal defense.

But the district’s attorneys, Lozano and Smith, advised the board its decision to defend Keesey is not an illegal expenditure.

“A gift of public funds occurs when an expenditure has no possible direct or indirect public purpose or when an expenditure is made only for the unjust enrichment of the recipient in circumstances when there is not a benefit to the public agency,” wrote attorney Dale E. Bacigalupi.
