NOTICE OF EXTENSION OF PUBLIC COMMENT PERIOD;
ANNOUNCEMENT OF PROPOSED PERMIT MODIFICATION,
REQUEST FOR PUBLIC COMMENT, AND PUBLIC HEARING ON
CLEAN AIR ACT PREVENTION OF SIGNIFICANT DETERIORATION PERMIT

Proposed Action: The United States Environmental Protection Agency (EPA) Region 9 provides notice of EPA Region 9’s proposed action to authorize modification of the federal Prevention of Significant Deterioration (PSD) permit at a facility operated by Collins Pine Company (CPC), located at 13 Collins Drive, Chester, CA 96020. EPA Region 9 is proposing to issue a revision of the current PSD permit for this facility that would grant conditional approval to CPC, in accordance with the PSD regulations (40 CFR 52.21), to replace the existing wet electrostatic precipitator (ESP) control equipment with a new dry ESP and ancillary equipment at its existing lumber manufacturing facility in Chester, California. Like the wet ESP, the proposed dry ESP will continue to reduce particulate matter emitted by Boiler No. 4 but will reduce the facility’s water use. The proposed modifications also include additional specifications regarding the kinds of fuel that the facility is allowed to use, including use of Ultra Low Sulfur diesel fuel during startup events. The proposed changes may result in minor emissions increases, but will not trigger any additional federal regulatory requirements pursuant to 40 CFR 52.21. The requested modification will not alter Best Available Control Technology determinations or emission limits of the existing PSD permit. The mailing address for CPC is P.O. EPA Region 9 previously issued public notice regarding this proposed PSD permit modification on March 30, 2016, and accepted public comment on the proposed modification until April 30, 2016. We are now announcing a public information meeting and public hearing on this proposed modification that will be held on October 27, 2016. We are also extending the public comment period from the date of this notice until October 27, 2016. Please see below for details on the comment period and the public hearing date.
Request for Public Comment: Any interested person may submit written comments regarding today’s proposed PSD permit modification. Comments should address the proposed permit revision. All written comments on today’s proposed action must be received by EPA Region 9 via e-mail by October 27, 2016, or postmarked by October 27, 2016. All written comments that are received on today’s proposed action will be included in the public docket without change and will be available to the public, including any personal information provided, unless the comment includes Confidential Business Information (CBI) or other information whose disclosure is restricted by statute. Information that you consider CBI or otherwise protected should be clearly identified as such and should not be submitted through e-mail. A transcript of the public hearing will also be included in the public docket. If you send e-mail directly to the EPA, your e-mail address will be automatically captured and included as part of the public comment. Please note that an e-mail or postal address must be provided with your comments if you wish to receive direct notification of EPA’s final decision regarding the permit.
EPA’s Final Permit Decision: EPA Region 9 will consider all new written and oral comments submitted during the public comment period, including those provided at the public hearing, before taking final action on the PSD permit modification. EPA Region 9 will send notice of the final decision to each person who provides contact information and who: (i) submits comments during the public comment period, including oral comments provided at the public hearing; or (ii) requests notice of the final permit decision. EPA Region 9 will respond to all new substantive comments in a document accompanying EPA’s final permit decision.
EPA’s final permit decision will become effective 30 days after the service of notice of the decision, unless:
A later effective date is specified in the decision; or
The decision is appealed to the Environmental Appeals Board pursuant to 40 CFR 124.19 (any person who submits written comments on the proposed permit or who participates in the Public Hearing may petition the Environmental Appeals Board to review any part of the permit decision within 30 days after the decision has been issued. Any person who failed to file comments and failed to participate in the public hearing on the proposed permit may petition for review by the Environmental Appeals Board only those parts of the final permit decision which are different than the proposed permit).
If EPA issues a final decision granting the PSD permit modification, and there is no appeal, construction of the modification may commence, subject to the conditions of the PSD permit and other applicable permit and legal requirements.
