General Work Description:

CONTRACTOR shall, at its sole cost and expense, furnish all facilities, equipment, and other materials necessary for crack sealing and remarking asphalt pavement as detailed in project specifications and project plans.

At the time this contract is awarded, the Contractor shall possess either a Class A License or any of the following Class “C” licenses which constitutes a majority of the work:  C-12 or C-32.

This contract is subject to the provisions of Section 22300 of the California Public Contract Code, which provides for the substitution of securities for any monies withheld by a public agency to ensure performance under a contract. The bidder’s attention is directed to said Section 22300 of the Public Contract Code for the specific requirements and provisions for such substitutions of securities if requested by the Contractor.

This contract is subject to state contract nondiscrimination and compliance requirements pursuant to Government Code, Section 12990.

Preliminary Advertisement

Sale of National Forest Timber

The Forest Service intends to advertise timber designated for cutting in the following proposed timber sale area on the Lassen National Forest prior to 10/31/2019. The Baker MP Thin Timber Sale is located approximately 16 air miles southwest of Fall River Mills, CA. This is a green thinning and group selection sale.  The sawtimber is marked and the non-sawtimber (3.0-9.9″ DBH) is not marked and will be designation by spacing. There are approximately 749 acres of thinning units and 47 acres of group selection units for a total of 796 acres. Sawtimber volume consists of primarily white fir (59%), sugar pine (4%), Ponderosa pine (3%), and incense cedar (1%) and approximately 33% of biomass volume.

This advance notice is to afford interested parties time to examine the sale area prior to regular advertisement. Interested parties may obtain information and maps about the sale area from the Hat Creek District Office, 43225 Highway 299 East, Fall River Mills, CA 96028. NOTICE OF PUBLIC HEARING

NOTICE OF PUBLIC HEARING RELATED TO THE POSSIBLE ADOPTION OF REGULATIONS FOR THE CULTIVATION OF MEDICAL MARIJUANA WITHIN THE INCORPORATED LIMITS OF THE CITY OF SUSANVILLE, AMENDMENTS TO TITLE 17 ZONING OF THE SUSANVILLE MUNICIPAL CODE

The City Council of the City of Susanville will hold a public hearing to solicit comments regarding the adoption of Ordinance No. 19-1017 amending various sections of Title 17, Zoning, of the Susanville Municipal Code. The proposed changes, if recommended to and adopted by the City Council, would adopt regulating medical and adult use Cannabis activities within the incorporated limits of the City of Susanville. The proposed amendments to Title 17 include definitions related to marijuana cultivation. Cannabis activities, as defined herein, shall be prohibited uses and unlawful in all zoning districts and other parts of the City, with the exception of those non-commercial cannabis activities expressly deemed to be lawful under state and local law such as those listed in Health and Safety Code section 11362.1.  However, personal cultivation of up to six cannabis plants outside upon the grounds of a private residence shall also be prohibited as allowed under Health and Safety Code section 11362.2(b)(3).  However, notwithstanding any other provision of this ordinance, the personal non-commercial cultivation for personal use of up to six cannabis plants within a private residence as described in Health and Safety Code section 11362.2(a) shall not be prohibited by this ordinance, but the City may develop and enact reasonable regulations to regulate such activity as provided in Health and Safety Code 11362.2(b)(1). No cannabis activities shall be established or continued if previously established, and no use permit, variance, building permit, or any other entitlement or permit, whether administrative, ministerial, or discretionary, shall be approved or issued for  Cannabis activities herein in any zoning district or other area within the City, and no person shall otherwise establish such businesses or operations conducting cannabis activities in any zoning district or other area within the City. Proposed violations of this ordinance may, but need not be, be prosecuted as a misdemeanor or an infraction, at the discretion of the City Attorney or the District Attorney.

The City of Susanville Planning Commission held a public meeting to consider the above-mentioned Zoning Code Amendment as described above on Tuesday, October 15, 2019 at 6:30 p.m. and recommended approval of the Draft Ordinance per Resolution No. 19-1081.

That Planning Commission also recommends that the City Council find that the adoption of the ordinance is exempt from the requirements of the California Environmental Quality Act under Section 15061(b)(3) of the California Code of Regulations which states: “The activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.”

In this instance the proposed ordinance relates to activities that are already occurring unregulated within the City. The proposed ordinance will simply require that the activity either occur within an existing residence or occur in the back yard of a lot which has a residential use on it that has already been developed with one or more dwelling units. Furthermore, the actual physical characteristics of cultivation: tilling of soil, watering, harvesting are the same as other accessory residential uses such as gardening, landscaping, etc. Therefore, it can be seen with certainty that no significant environmental impacts will occur as a result of the proposed regulations.

SUMMARY OF AMENDMENT TO TITLE 11 CHAPTER 14 OF THE LASSEN COUNTY CODE

ADOPTED BY THE LASSEN COUNTY BOARD OF SUPERVISORS

ON SEPTEMBER 17, 2019

Title 11 Chapter 14 of the Lassen County Code establishes the structure and authority of Lassen County’s emergency organization in case of declared local emergency.

Amendments to Title 11 Chapter 14 of the Lassen County Code were adopted at the regular meeting of the Lassen County Board of Supervisors held on September 17, 2019.

The amendments to this title and chapter do several things:

1. Redefine the term “local emergency” to be consistent with state law; and

2. Change the composition of Lassen County’s Disaster Council; and

3. Clarify and restate the Powers and Duties of the Sheriff and the Director of Emergency Services.
